Any property that is taken is valued at nine hundred fifty dollars ($950) or less, then the theft is considered the California crime of petty theft under Penal Code 484 & 488 PC.

The majority of petty theft cases arise when someone simply physically takes property that belongs to someone else. This is known as “theft by larceny.”

The following are other types of Petty Theft:

1. Theft by trickery.

2. Theft by embezzlement

3. Theft by fraud

Any one of these petty thefts and shoplifting are misdemeanors. If you are a first offender, you may qualify for DEJ (deferred entry of judgment). DEJ does not constitute a conviction as sentence is not being imposed. DEJ is for a period of 90 days during which time, as long as there is no new law violation and complete a DEJ class, a dismissal can be earned.
